On 23rd March 2023 we marked eight years since the possession order for our home was made, which is contrary to Commonwealth Law, and we were not present in the court, the attorney representing us “put by mistake” the date, and “came unprepared”, as the Privy Council nicely uplifted it in 3rd April 2017 Judgment.

But the lawyer for UBS lied to the honorable judge three times during the hearing on 23 March 2015 and obtained that judgment. 

Our trial still has no date, as UBS still has no one expert – witness, while we have all four as from the Court’s order.

On Friday 23rd March 2023 we had a hearing in the Court of Appeal of the Bahamas for leave to appeal to the Privy Council, since two of our applications (of 15 February 2018 and 17 February 2020) were promised to be .heard in multiple occasions since 2018, but when finally we was before the panel (three judges from the Court of Appeal composing panel) our Applications were dismissed on preliminary points in this 3-part ruling of 26 October 2022, heard on 22 September 2022:  – dismissing two our applications, – and even awarding the costs to the UBS, as if it was our fault that the Court for all those years refused to hear us.

And on 23rd March 2023 we had an honour to appear before the panel composed by  His Lordship the Honourable Sir Ian Winder, the Chief Justice of the Bahamas, Hon. Madame Justice Indra Charles – the rulings of these two judges are law-making in the country, a precious resource for all who are engaged in litigations in this jurisdiction.

 I was really shaken to see them on the panel.

The panel was led by The Hon. Mr. Justice Roy Jones.

The lawyer for UBS lied again – eight years taught him nothing:

He probably does not posses conscience or dignity, he went on putting ahead his preliminary objection, based on the two case law, distinguished from our case, where appeal had no even number assigned while in our case one of two applications is even a part of record of Appeal Bundle – item 33. 

Then he re-entered a lie with which he kept the court during the last hearing on 22 September 2022, for more then an hour, you can see it in transcripts here. Afterwards we were ordered to file the Affidavit on 26 September 2022, with details about the Privy Council proceedings, which are ongoing.

It remains incomprehensible to me how any professional can stoop to such a behaviour, especially a lawyer who is also an officer of the court, speaking before the judges..

The Court reserved its ruling.

I truly hope that Justice will see light now, that we will be heard, and that this particular lawyer will be finally called to be accountable for all his unacceptable unconscionable acts.
