As for our updates, pre-announced on June 11, we continue to fight, even though the issue that our trades were not sent to NYSE, despite that UBS AG and its subsidiaries has produced false records, saying that all ur trades were executed on NYSE, and UBS stocks are listed in the US, seems, not of interest in the US Courts so far, where we were dismissed in the Court of Appeals for the 2nd circuit. 

Considering the $bln lost in revenues, taxes and fees, thousands of jobs, we are surprised, to say less. Was UBS action not exactly what is addressed in the anti-fraud provision under Rule 10b-5 of the Securities Industry Act of 1934, which prohibits the use of any “device, scheme, or artifice to defraud.”? Was it not and still one of the main concerns of the US Congress – the trust of investors in the US regulated Exchanges? Is it now free to create any false records regarding any securities registered on regulated exchanges, as it was in our case of our ETFs traded on NYSE and a few on Nasdaq? We will continue to find out and will update you.

Even more unexpected was in the Bahamas when on the hearing of 14 June 2023, the Judge of the Supreme Court did not give any importance to the Ruling of 8 May 2023, where UBS was found to intentionally create delays for four years and we were prejudiced, the trial date was not settled. Rather the date was given for hearing UBS application to sell our home together with our applications opposing it, and after that another day where all our preliminary applications will be heard or scheduled.

This was unexpected , to say less. But will see, work and update you with our news.
