I hope that despite the turbulent and war-filled days we are living through, you are finding inner peace and faith in the victory of light.

I have some good news to share about the three dates of the Court of Appeal hearing before the Registrar for the attempted taxation, initially scheduled for November 28, 29, and 30, 2023 I wrote about , which was supposed to be the final court proceeding, was stayed. Despite that our claims have never been heard, our trial vacated four years ago and UBS has no defense, there has been no witness or document to defend against our illegality claims.

None of our letters persuaded the registrar to vacate this date. Only the motion for a stay of taxation to the full panel of the Court of Appeal deprived her of jurisdiction.

You should have seen the unbelievable and unacceptable behavior of UBS’s female lawyer. She was literally yelling at me, not allowing me to speak at all, to the point that I had to ask Madam Registrar to make order in the room and prevent UBS’s attorney from barking at me every time I tried to speak. Only then was I able to present a few arguments.

We were then left hanging, waiting for the court to appoint the hearing before the full panel. Finally, we were advised that it will be listed in January. Well, after being homeless for five years and having waited for the appeal hearing for two years, this speed in an application for a stay of taxation (not a stay of execution, which are normally urgent) represents another oddity of the system’s treatment of our case.

And this week, on 8 December, we have a very strange and dangerous hearing of UBS’s application to take over our house for free, along with our applications opposing it.

Well, last week, the Bahamian community learned that, by a unanimous decision of the Court of Appeal, stolen cars are legal and the bank, which knew that the Carfax reports were defective and the cars were stolen, has issued the loan, is not guilty at all. All the blame is placed on the customer who dared to trust the bank and thought that once the bank informed her that they would run Carfax reports, it was a guarantee that the cars were legally imported into the Bahamas. And the lawyer who’s secretary inadvertently filed in the wrong court, since it was during the COVID days, family loss, personal struggles of encountering COVID, and a plain clerical error, this is inexcusable.

But stolen cars are welcome, no problem.

I truly hope that this case will be brought to the Privy Council, but people are so often giving up… it’s sad and justice is not vindicated.
