Our July 2026 was tough. Our youngest son is now 17 years old, and that is how long Credit Suisse–UBS has continued to ruin our family life.
While the world observed the decline of the hedge fund Situational Awareness, I wrote about here, our own court events were also quite unbelievable. My request to adjourn one matter because of my husband’s medical certification was accepted by one court but refused by another.
On 28 July 2026, the Supreme Court of The Bahamas, Honourable Madam Justice Carla Card-Stubbs, heard UBS’s application, filed on 2 June 2026, seeking permission to sell our family home at a fraction of its value. The application comes only four months before the trial—a trial that has been delayed since 2019 by UBS, as the Court itself found in the unappealed Judgment of 8 May 2023.
My application for a stay and leave to appeal was heard on 23 July 2025.
As of today, 1 August 2026, the Court has not yet delivered its decision.
Our three applications, filed in 15 May 2017, 28 June 2017 and on 21 February 2024, challenge the very basis upon which the sale is sought. In those applications, we filed evidence before the Court showing that the underlying judgment was obtained by fraud. That evidence has long been before the Court. Despite the Order of 28 April 2025 directing that both applications be heard, they remain unlisted.
The trial itself—after “only” twelve years of litigation—is now only four months away 29 November-10 December 2026.
If UBS succeeds on 17 September 2026, we may lose our family home and be left penniless. Under Bahamian law, once a foreign litigant no longer owns real property in the country, the Court may order security for costs. UBS could therefore walk away without returning the US$575,000 taken from our trading account in 2009—now worth well over US$1.6 million with interest—and without ever answering for the breaches and frauds we say it committed.
Our trial was intentionally delayed by UBS — please see paragraphs 32 and 34 of the unappealed judgment delivered by Honourable Judge Ian Winder, as he then was, our CJ, Knight, KC. Once we present our witnesses and evidence of what we say was UBS’s unlawful operation, our claim exceeds US$18 million, including interest as of today. Against that background, UBS seeks to sell our home to satisfy a debt of approximately US$1 million—a debt which we say arose from a judgment obtained by fraud.
The mathematics speaks for itself.
I continue to believe that justice will prevail. After more than twelve years before the courts, I cannot believe that our case will be brought to an end without a single court ever hearing the evidence on its merits.
Call it skill—I call it shame. The delays, the manoeuvring, and the misrepresentations to the courts have prolonged this litigation far beyond what justice should ever permit.
Yet the good story continues.
Not only did we reach a settlement with the Securities Commission of The Bahamas (SCB), but during the short hearing for the Consent Order I had the pleasure of observing the professionalism of the SCB’s counsel, Gladstone Brown. The presentation of our agreement to the Court was excellent. Every word spoken was exactly as agreed, reflecting the care and precision with which the matter had been prepared.
One final thought has stayed with me, maybe not exact words but the meaning:
“After more than a decade of practice, I have realised that we litigate too much, often forgetting that we are human beings. It is always better to find a way to get along.”
I sincerely hope more lawyers hear those words—and live by them.
