“The law is reason free from passion.” — Aristotle
Ten years waiting to be heard — yet our resolve for justice only deepens. Three suns — three chances. Against all odds, Justice will prevail.
Dear Friends and Supporters,
We hope you all are enjoying the second month of autumn — the life, and all the positive we can find on our troubled Earth planet.
Yesterday, our long-awaited hearing was adjourned to 11 December 2025 — just two more months, after already waiting for 127 months, since 23 March 2015, when, by delivering 14 false statements and using an affidavit containing 8 false statements, UBS’s lawyer was “successful” in obtaining Summary Judgment, throwing our family into this ten-year-long ordeal, during which we have never once been heard on the merits — neither on our defence nor on our counterclaim.
At yesterday’s hearing, Judge Carla Card-Stubbs also did not allow the presence of our supporters — Lucy Komisar, the award-winning U.S. investigative journalist (Gerald Loeb Award, New York), who in August 2024 first exposed the UBS & Credit Suisse “Fictitious Trading” fraud, and whose investigations continue to reveal global financial corruption; and James S. Henry, Esq., a distinguished attorney, Harvard graduate, Yale lecturer, and leading investigative economist with decades of experience advising Congress and international bodies. His work focuses precisely on the global justice issues at the heart of this case — financial corruption, kleptocracy, and transparency.
I argued that granting Mr. Henry access would provide the court with a uniquely qualified observer whose expertise is directly relevant to the proceedings and would help us tremendously as we continue to act pro se. My argument was denied, and I was warned that if I persisted, I risked being held in contempt.
Our minor application was heard: we asked that UBS’s affidavits must be sworn by the proper person, not by a liquidator’s associate, as they continue to do in breach of the law. We argued that Lena Bonaby, who has been swearing these affidavits, with 41 plain inaccuracies in the last one, is a partner of the liquidator (a law firm and real estate agency) — the same person who twice produced an unqualified real estate report valuing our home at $1 million, when its true market value was $3.7 million, as confirmed by three certified appraisals. Such a dual role and clear conflict of interest, which taints the very integrity of her affidavit, should never have been accepted by the Court. This was dismissed.
The trial is set for 30 November to 10 December 2026.
We are now considering an appeal regarding both of yesterday’s decisions — the exclusion of our observers and the dismissal of our argument on the improper affidavit deponent.
As we say in Russian, “God loves a trinity,” and now, as the third hearing approaches, we believe that Justice will win. As unique as the photo of the three suns we share with this post, so unique is this long thirst for justice.
Just as it is almost impossible to see three suns in the sky, so it may seem impossible for two parents with six young adults to stand against a giant corporation — yet we know that Justice will prevail.
With patience we go, with trust we live.
